The 2 Mandatory Insurance Policies Simplification of Procedures and New Standards: A Step Forward for the Heavy Transport Industry and the Financial Capacity of Auto Revision Centers 2024

Do you need the Professional Liability Insurance Policy for registration in the Register of Inspectors of Heavy Vehicle Revision Centers?

The recent Decree No. 237 of September 21, 2023, has brought a significant transformation in the rules governing Authorized Heavy Vehicle Centers. This change is the result of a meticulous review of existing regulations, with contributions from organizations like Confartigianato.

The main innovations of the decree include the simplification of certifications for Authorized Centers. Now, only the ISO 9001 Quality Certification is required, eliminating the previous need for ISO 17020 IEC Certification.

In addition, simplifications have been introduced in structural requirements: the minimum surface area required for Centers is now 250 sqm, with 200 sqm per revision line and an external maneuvering area of 600 sqm.

The decree maintains the financial capacity requirement at 155,000 Euros for Authorized Centers, but removes the need to demonstrate a minimum turnover of 300,000 Euros over the past three years and to submit annual reports.

Additionally, an 18-month transitional period has been established to allow workshops to adapt to the new rules. Finally, there is no longer an expiration date for the authorization release, with a process that involves the Provinces/Metropolitan Cities and well-defined procedures, including initial checks by the territorial offices of the Motor Vehicle Department.

The Financial Capacity Certification for Revision Centers

The financial capacity of 155,000 euros for revision centers is a financial requirement that must be met to obtain authorization to operate as a vehicle revision center. This requirement was introduced to ensure that revision centers have a solid economic base and are able to maintain high standards of quality and safety in their operations. Here are some key details about this provision:

  1. Solvency Guarantee: A financial capacity of 155,000 euros demonstrates that the revision center has the necessary financial resources to effectively manage its activities, including the maintenance of equipment and staff training.
  2. Legal Requirement: This amount is often set by national or regional regulations and serves as a criterion for the center’s license or accreditation.
  3. Forms of Demonstration: Financial capacity can be demonstrated through financial guarantees, also called Financial Capacity Certification.
  4. Quality and Safety Objective: Ensuring that revision centers have adequate financial resources is fundamental to ensuring that vehicles are thoroughly inspected and comply with current regulations, thus ensuring road safety.
  5. Renewal and Verification: This requirement must be periodically renewed or verified to maintain the accreditation of the revision center.
  6. Implications for New Centers: For new revision centers, meeting this requirement may represent an initial challenge, but it is an essential step to enter the market. It is important for auto revision centers to ensure they understand and comply with all financial requirements required by local regulations to operate legally and maintain high standards of quality and safety.

The Professional Liability Insurance Policy for Registration in the Register of Inspectors of Heavy Vehicle Revision Centers Article 7 of Decree No. 237 of September 21, 2023, has confirmed the amount of the cap for the Professional Liability Insurance Policy.

The Professional Liability Insurance Policy (RC Professionale) for registration in the Register of Inspectors of Heavy Vehicle Revision Centers is a specific insurance coverage required for these professionals. This policy aims to protect them from any claims for damages arising from errors, omissions, or negligence committed in the exercise of their professional activity.

The main features that this policy should have include: Adequate Coverage: The coverage amount should be high enough to cover any compensation that may arise from professional errors, the minimum set by the recent Decree No. 237 of September 21, 2023, is always 500,000.00 Euros.

Coverage for Errors and Omissions: It should protect the inspector in case of errors, omissions, or negligence committed during the inspections of heavy vehicles.

Temporal Validity: The policy must be valid for the entire period in which the inspector is registered in the Register and carries out his activity.

Geographic Coverage: It should provide coverage in all geographical areas where the inspector operates.

Reasonable Deductible: The deductible, i.e., the part of the damage that remains the responsibility of the insured in the event of a claim, should be reasonable and proportionate to the risk.

The Accident Insurance Policy The same Article 7 of Decree No. 237 of September 21, 2023, requires an additional insurance policy for risks related to damages caused to people or property, as well as for workplace accidents involving oneself and third parties, occurring in the exercise of one’s function during the testing of heavy vehicles;

We also provide this policy:

The insurance policy that covers risks for damages caused to people or property, as well as for workplace accidents involving oneself and third parties, occurring in the exercise of one’s function during the testing of heavy vehicles, is typically a combination of different insurance coverages.

These can include:

  • Workplace Accident Policy: Protects the staff of the revision center in case of accidents occurring during work hours. This type of policy is particularly important in an environment like a revision center, where operators are exposed to risks related to the maintenance and testing of vehicles.
  • Liability Insurance for Damages to Vehicles in Custody: Specific for revision centers, this policy covers any damages to vehicles while they are under the custody of the center, for example, during testing. It is important that the revision center carefully assesses the risks associated with its activities and chooses a combination of insurance coverages that offer adequate protection. The accident insurance is a type of insurance that provides coverage in case of accidents suffered by the insured. This policy is designed to offer financial protection in various situations where physical injuries occur.
  • Here is an overview of what it covers and how it works: What It Covers: Medical Expenses: Covers medical and hospital expenses incurred as a result of an accident.
  • This can include medical visits, surgeries, medications, physiotherapy, etc. Temporary or Permanent Disability: Provides compensation if the accident causes temporary disability (temporary inability to work) or permanent disability (long-term or permanent changes in the individual’s physical capacity). Death: In the event of the insured’s death due to an accident, the policy provides a payment to the designated beneficiaries.
  • Daily Allowance: Some policies may offer a daily allowance to compensate for loss of income during the recovery period from an accident.
  • Rehabilitation: Covers the costs associated with rehabilitation after an accident. How It Works: Subscription of the Policy: The insured chooses the accident policy and pays a premium, which can be annual, semi-annual, or monthly.
  • Definition of Accident: The policy usually defines what is meant by “accident” – typically sudden and unintentional events that cause physical injuries. Covered Events: The coverage is generally valid for a wide range of accidents, which can include domestic, sports, road accidents, and in some cases, even workplace accidents. Claim Process: In case of an accident, the insured (or the beneficiaries, in case of death) must submit a claim to the insurance, providing documentation such as medical certificates, accident reports, etc. Evaluation and Payment: The insurance evaluates the claim and, if approved, makes the payment of the compensation according to the terms of the policy. Points to Consider: Limitations and Exclusions: It’s important to read the contract carefully to understand which accidents are covered and which are excluded (e.g., accidents due to extreme sports or pre-existing conditions).
  • Compensation Amount: Varies depending on the type and severity of the accident, and according to the limits established in the policy. Customization: Policies can be customized according to individual needs, for example, by increasing the insured capital or including additional coverages. In general, the accident insurance is an important tool to mitigate the financial impact of accidents, especially for those who do not have other forms of insurance coverage for these eventualities.
